MVP (Concierge) Service Phase

Important Notice: ParknStore is currently in its initial launch phase, operating as a minimal viable product (MVP). We are manually facilitating connections and payment processing between early-adopter Hosts and Guests as we build our full automated platform. Service during this phase is provided on a "best-effort" basis.
Nature of This Phase
During this MVP phase, ParknStore acts as a manual facilitator and payment intermediary. Our team will help connect interested Hosts and Guests, facilitate the creation of rental agreements, and process payments to test our systems. This process is designed to validate our service in a real-world setting with a limited number of users.
Payment Processing During MVP
No service fees will be charged by ParknStore during this MVP phase. We are manually processing payments to test our systems. The full amount paid by the Guest will be disbursed to the Host, minus only any actual payment processing costs we incur from third-party providers. This allows us to validate our platform before introducing our standard service fee of 15% or less at launch.
Limitation of Liability in MVP Phase
Given the manual and testing nature of this phase, ParknStore's liability is further limited. We facilitate connections and payments in good faith but cannot guarantee the performance, suitability, or reliability of Users. All interactions and agreements between Users are at their own risk. Our total liability arising from the MVP service is limited to NZD $100.
Transition to Full Platform
Upon official launch of the automated ParknStore platform, all future bookings and transactions will be governed by our standard Terms of Service (outlined in the sections below), which will include automated payment processing and the applicable service fee. Users will be notified before this transition occurs.
1. Acceptance of Terms
Welcome to ParknStore! These Terms of Service govern your use of our platform connecting space owners ("Hosts") with those seeking parking and or storage solutions ("Guests").
By accessing or using ParknStore.co.nz, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our platform.
Important: These terms contain a binding arbitration agreement and class action waiver that impact your rights about how to resolve disputes.
2. Definitions
- ParknStore: The ParknStore.co.nz Platform, operated by the founder and team, which connects Hosts and Guests for parking and storage solutions.
- Host: A person or entity listing a parking or storage space on the ParknStore platform.
- Guest: A person or entity renting a parking or storage space through the ParknStore platform.
- Space: The specified parking or storage area at the Host's property.
- Booking: A reservation agreement between a Host and Guest for use of a Space.
- Total Fee: The full amount paid by the Guest for a Booking, including any applicable taxes.
- Service Fee: The commission retained by ParknStore for facilitating the transaction. This fee is currently $0 during the MVP phase.
3. Platform Role
ParknStore acts as a payment processor and platform facilitator. We are not a party to rental agreements between Hosts and Guests. We provide the technology platform to facilitate connections and process payments but do not own, manage, or insure spaces and items parked/stored at the space.
Platform as Payment Processor: ParknStore processes all payments between Hosts and Guests. We collect payments from Guests and distribute funds to Hosts, minus our service fee.
4. User Responsibilities
Host Responsibilities:
- Provide accurate and truthful descriptions of Spaces
- Ensure Spaces are safe, legal to rent, and comply with all local regulations
- Maintain appropriate insurance for their property
- Clearly communicate access instructions and rules to Guests
- Respond promptly to Guest inquiries and Booking requests
Guest Responsibilities:
- Verify that Spaces meet their needs before Booking
- Use Spaces only for lawful purposes and in accordance with Host rules
- Maintain insurance for stored vehicles or items
- Leave Spaces in the same condition as when the Booking began
- Make timely payments as outlined in these Terms
5. Payment Processing
MVP Phase Notice: During the MVP phase, we are manually processing payments to test our systems. No service fees are being charged, and the full amount paid by Guests (minus any actual payment processing costs we incur) is being disbursed to Hosts.
Service Fees
ParknStore charges a competitive service fee of 15% or less on each booking. This fee is deducted before disbursing funds to Hosts and allows us to provide a secure, reliable platform and continuous customer support. The exact fee will be clearly displayed before confirmation. Guests pay the full advertised price with no additional fees.
Payment Collection
We collect payments from Guests at the time of Booking confirmation. Funds are held securely until 24 hours after the rental period begins, then released to the Host (minus our service fee).
Payout to Hosts
Hosts will receive payment for confirmed Bookings within 3-5 business days after the Booking period begins, minus the ParknStore service fee.
6. Refund Policy
How ParknStore Processes Refunds
ParknStore acts as a payment intermediary. While we strive to pay our Hosts promptly, we understand that situations requiring a refund may arise. Here is our process for handling refunds after funds have been disbursed to the Host.
1. The Refund Agreement is Paramount
All refund requests must first be discussed and mutually agreed upon between the Host and the Guest. ParknStore will not initiate a refund without written confirmation from both parties.
2. The Process: Reversing the Transaction
When a refund is agreed upon after we have paid the Host, the process involves the Host repaying the amount to ParknStore, or ParknStore deducting from future payouts if the Host is uncooperative.
3. Service Fees on Refunds
Our service fee is also refunded, meaning the Host is refunded their full payout, and the Guest receives a full refund.
7. Prohibited Items
Guests may not store the following items in any ParknStore space:
- Weapons, firearms, ammunition, explosives
- Hazardous, toxic, or flammable materials
- Live animals or plants
- Perishable food items
- Cash, securities, or precious metals/stones
- Illegal or stolen goods
Storage of prohibited items will result in immediate termination of your account.
8. Cancellation Policy
Grace Period
Both Hosts and Guests may cancel any booking within 24 hours of confirmation without penalty.
Standard Cancellations
After the 24-hour grace period, cancellations require 30 days' written notice.
Host-Initiated Cancellations
If a Host cancels a confirmed booking after the grace period, they may be subject to penalties including temporary suspension.
9. Liability Limitations
No Insurance Provision
ParknStore does not provide insurance coverage for stored items.
Platform Liability
ParknStore's liability is limited to the total fees collected in the 6 months preceding any claim, not exceeding NZD $500.
User Responsibility
Hosts and Guests are solely responsible for their own property and compliance with laws.
10. Dispute Resolution
Mediation Process
In case of disputes between Users, ParknStore will attempt to mediate a resolution. However, we are not obligated to mediate.
Arbitration Agreement
By using our platform, you agree to resolve any disputes through binding arbitration rather than in court, except for small claims matters.
Governing Law
These Terms are governed by the laws of New Zealand.
11. Changes to Terms
We may update these Terms from time to time. Continued use after changes constitutes acceptance.
It is your responsibility to review these Terms periodically.
12. Intellectual Property & Copyright
12.1 All content on the ParknStore website and mobile application, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, code, software, and the "look and feel" of the platform, is the exclusive property of ParknStore or its licensors and is protected by New Zealand and international copyright laws.
12.2 You may not copy, reproduce, modify, publish, transmit, distribute, perform, display, sell, frame, create derivative works from, or link to any content on the ParknStore platform without our prior written consent.
12.3 "ParknStore", the ParknStore logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ParknStore. You may not use these marks without our express written permission.
12.4 You may not include links to the ParknStore website or app from any other website or application without our prior written consent.
13. Indemnity
You agree to indemnify, defend, and hold harmless ParknStore, its directors, officers, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:
- (a) your breach of these Terms or any Space License Agreement;
- (b) your use of the Platform or any space booked through the Platform;
- (c) your violation of any applicable law or third-party right;
- (d) any dispute between you and another user (Host or Renter);
- (e) any content or information you submit through the Platform.
14. Disclaimer of Warranties
14.1 THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND.
14.2 TO THE FULLEST EXTENT PERMITTED BY LAW, PARKNSTORE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
14.3 PARKNSTORE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.
15. Availability of Service
15.1 Due to the nature of software and the internet, ParknStore cannot guarantee uninterrupted or error-free access.
15.2 ParknStore shall not be liable for service interruptions due to circumstances beyond our reasonable control, including ISP failures, cyberattacks, power outages, or government actions.
15.3 We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. ParknStore will not be liable to you or any third party for any modification, suspension, or discontinuance of the service.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall continue in full force and effect. The parties agree to replace any invalid, illegal, or unenforceable provision with a valid, legal, and enforceable provision that achieves the same essential objectives.
17. No Waiver
No failure or delay by ParknStore in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or remedy preclude any other or further exercise thereof or the exercise of any other right, power, or remedy. Any waiver of any provision of these Terms must be in writing and signed by an authorised representative of ParknStore to be legally binding.
